Passenger Transport Agreement

The parties

Passenger: the person who sends the request and takes the journey.
Subject matter and formation
This agreement sets out the terms of the passenger transport service between the agreed pick-up and drop-off points.
The agreement is formed when the request is mutually confirmed. Pressing a button on the site does not on its own form a contract; the journey becomes final when both sides agree in an exchange of messages. As no payment is taken on the site, this is not a distance sales contract.
Scope of the service
- Transport is carried out from the agreed pick-up point to the agreed drop-off point.
- The vehicles are not owned by Ertürk Turizm. Transport is performed through contracted carriers and their drivers. Organising and coordinating the service is the responsibility of Ertürk Turizm.
- The vehicle is planned according to the number of passengers and the amount of luggage. If a particular vehicle class was agreed in the exchange of messages, a vehicle of that class is assigned.
- Luggage handling is included in the fare; no separate charge is made. Luggage of unusual size or weight must be notified in advance.
Airport meeting and waiting
- On airport transfers your flight is tracked; in the event of a delay the meeting time is adjusted to the actual landing time.
- Telling us your flight number in advance is necessary for that tracking to be possible.
- Free waiting time after landing is 30 minutes. Whether an extra charge applies to waiting beyond that is agreed in the exchange of messages.
- The meeting point and how you will be met are notified in the exchange of messages before the journey.
The passenger's obligations
- The accuracy of the pick-up address, the time, the number of passengers and the contact details is the passenger's responsibility.
- The passenger is ready at the pick-up point at the agreed time.
- Changes to flight times, delays and similar circumstances are notified by the passenger.
- Applicable legislation is observed in the vehicle: seat belts are worn and there is no smoking.
- Any need for a child seat must be notified in advance.
Fare and payment
- The fare is the amount confirmed in the exchange of messages, and it is fixed.
- No surprise charge is added at the end of the journey. If the route, the waiting time or the number of passengers changes at the passenger's request, the difference in fare is notified in advance.
- Whether bridge, motorway and parking charges are included is stated in the exchange of messages.
- No payment is taken on the site. The method of payment is agreed in the exchange of messages.
Cancellation and changes
- When the passenger wishes to cancel the journey or change its time, they notify us as soon as possible.
- Cancellation is free of charge up to 1 day before the time of the journey.
- If Ertürk Turizm cannot carry out the journey for reasons outside its own fault (vehicle breakdown, weather conditions, road closure, force majeure), it informs the passenger immediately and, where possible, arranges an alternative vehicle.
Liability
- Ertürk Turizm is responsible for organising and coordinating the service.
- Liability arising during transport is determined within the framework of the applicable road transport legislation and compulsory insurance provisions.
- Ertürk Turizm is not responsible for belongings left behind in the vehicle; if they are found, reasonable effort is made to return them to the passenger.
- Ertürk Turizm cannot be held responsible for delays and losses arising from the passenger's own fault, lateness or a wrongly given address.
Passenger reporting
In road passenger transport, reporting the journey and its passengers is required by legislation. Once your journey is scheduled, your passenger details are reported to the Ministry of Transport and Infrastructure's U-ETDS system. For that reason your name, surname and identity/passport details may be requested before the journey. See the Data Protection Notice page for details.
Disputes
This agreement is governed by the law of the Republic of Türkiye. The courts and enforcement offices of Istanbul have jurisdiction over disputes. Passengers who qualify as consumers keep their right to apply to consumer arbitration committees and consumer courts.
